Timing at the Kilogram-Scale Mushroom Handoff

A patent for kilogram-scale fly agaric extract arrives after a multistate poisoning outbreak and an FDA warning about putting its compounds in food.

What changes in this design

The record does not set out a usual mushroom-extraction method. A reader might otherwise think of an extract simply as material taken from a mushroom, without any stated target for the relative amounts of muscimol and ibotenic acid.

Here, the processes are aimed at raising muscimol and lowering ibotenic acid in Amanita extracts. They also address selecting mushroom biomass, making extracts at kilogram scale, and putting the extracts into compositions or beverage formulations.

That focus helps explain why the work is about more than collecting an extract. It concerns the makeup of the extract, choosing starting mushroom material, and carrying the process into larger quantities. What it measures is not stated.

Fifty-four candy samples

In 2024, 180 people in 34 states became ill after consuming Diamond Shruumz mushroom chocolates and related products. Forty-three point seven percent were hospitalized, 23.2% required intensive care, and two people died. The number that caught my attention was the 54 product samples tested by the FDA: muscimol appeared alongside psilocin, kavalactones, acetylpsilocin, and pregabalin.

That mixture does not establish that muscimol alone caused every injury. It does make my confidence in the category much lower. A bright wrapper and a mushroom label can conceal a remarkably uncertain product, especially when its intended effect depends on compounds that vary by species, specimen, preparation, and dose.

December 18, 2024

Two months after the outbreak period covered by the public-health report, the FDA sent industry a direct warning. Amanita muscaria, muscimol, ibotenic acid, and muscarine, it said, are unapproved food additives and are not generally recognized as safe. The agency's position is that food containing them is "adulterated."

That wording changes my view of any patent that treats Amanita extract as a drink ingredient. The question is no longer only whether a maker can remove enough ibotenic acid, or produce a consistent batch. It is whether a technically cleaner extract can enter food at all under the regulator's stated position. The FDA said it had reviewed more than 600 scientific publications and pointed to reports including central nervous system depression, seizures, convulsions, coma, and death.

Fourteen litres of water

Against that backdrop comes US20260256858A1, assigned to Psyched Wellness. Its aim is industrially tidy: select mushroom biomass, extract muscimol at kilogram scale, lower ibotenic acid, and use the resulting material in compositions including beverages. The related international application describes 14 litres of water for each kilogram of mushroom, extraction near 80 degrees Celsius, then roughly four and a half hours of reflux at 95 to 100 degrees Celsius.

The sibling filing also targets a muscimol-to-ibotenic-acid ratio from 10:1 to 200:1. It sets limits for arsenic, lead, mercury, and total aflatoxins. Those are real process targets, and I read them as evidence that the company understands the supply problem. But the numerical exactness sharpens my concern rather than resolving it: contaminant specifications address particular hazards, not the legal status of a food ingredient or the full safety of a concentrated psychoactive extract.

Twenty kilograms of mushroom

This is not the company's first effort to control that chemistry. An earlier filing, with a March 2021 priority date, described drying the mushroom to 2-4% moisture, acidifying it to pH 2.5-3.0, and using vacuum distillation while claiming muscimol purity above 90%. A 2013 patent from an unrelated inventor proposed another route altogether: purified glutamate decarboxylase or Lactobacillus fermentation, rather than acid and heat.

A 2021 report described the company's largest extraction at that time as 4.2 kilograms of extract from 20 kilograms of raw mushroom. The new application is the third step in a five-year progression toward larger, more standardized production. That history makes our focus on biomass selection easier to understand. It also shows that scaling is a continuing engineering task, not a settled answer to the mushroom's variable chemistry or its long record of dangerous misidentification.

May 31, 2026

The patent's named inventor Jeffrey Stevens resigned as Psyched Wellness chief executive and director effective May 31, 2026. A director resigned days later, and the board announced a strategic review while appointing an interim chief executive. Those events do not tell us whether the extraction process works, and I would not claim that they do.

They do place the filing in a company trying to turn a wild, legally complicated ingredient into a repeatable consumer product while its leadership changes. The patent is a technical document. Its commercial setting is less stable, and that matters when the claimed end products include beverages.

Where this leaves things

Louisiana separately prohibits Amanita muscaria for human consumption, with criminal penalties for production, distribution, and possession. That state rule is distinct from federal food regulation, but it exposes the gap between an unscheduled substance and a product that can safely and lawfully be sold as food. The company's earlier public rationale for pursuing muscimol rested partly on that unscheduled status.

At the end, I read this filing as a serious attempt to impose controls on a difficult raw material, not as proof that the problem has been solved. Its ratios, temperatures, and heavy-metal limits are useful signs of where uncertainty lives. The FDA warning, the multistate outbreak, and the older poisoning reports leave little room for the comforting idea that better extraction alone makes Amanita a routine beverage ingredient.

The record, briefly. US20260256858A1, “Amanita Muscaria Mushroom Extracts And Products, And Improved Processes For Producing Extracts Of Amanita Muscaria Mushrooms At Kilogram Scale” Describes processes for extracting muscimol from Amanita mushrooms, particularly Amanita muscaria, that increase muscimol and decrease ibotenic acid, including kilogram-scale extraction, biomass selection, and compositions or beverage formulations using the extracts.
